A recent change in the law made it illegal for anyone to sell tickets in a public place in a bid to cut out the expected trade for this summer's tournament.
The FA had also reached an agreement with auction site eBay to ban the sale of World Cup tickets.
However, a loophole has emerged with the resale of tickets on the internet because the web is not a public place, according to the Home Office.
"Touting on the internet is not considered a criminal offence," said a spokeswoman for the Home Office.
